Aside the legal brouhaha, former Infinity Ward bosses, Jason West and Vince Zampella, have made their ambitions for their future evident. That said, this morning, Electronic Arts revealed a deal with the pair to be the sole distributor for their newly formed studio, Respawn Entertainment — based in the same part of Los Angeles as Infinity Ward.

“Respawn Entertainment marks a fresh start for Jason and me,” said Zampella, the studio’s general manager. “For the past decade we led a great development team and poured our hearts into creating an epic game franchise….Today we hope to do it all over again–open a new studio, hire a great team, and create brand new games with a new partner, EA.”

The legal confrontation between Activision and former Infinity Ward executives, Jason West and Vince Zampella, is hindering the development of the third Modern Warfare installment. According to Activision’s countersuit documents, because of their departure, Activision has had to “commit additional resources” onto the project.

The court documents state that, because of they were planning to secede from the company, they were purposely “delaying pre-production of Modern Warfare 3“, and that this delay is being used as a “leverage” in their “negotiations” against Activision.

However, since the countersue was made public, West and Zampella’s attorney has responded to Activision’s claims calling them “false and outrageous”. And that the countersuit is just another attempt by Activision to keep from paying out “millions of dollars” owed to developers and their former co-workers at Infinity Ward.

Though the developer recently released the industry fastest grossing title, Infinity Ward still lost two company heads; even though the company was considered as “intangible”. However, these loses aren’t economically related. According to big brother company Activision, Infinity Ward’s Jason West and Vince Zampella were simultaneously left go due to “breaches of contract”.

However, Activision doesn’t believe that these loses will “have a material impact on the company.” But, on the contrary, industry analyst Ben Schachter believes that their dismissing could have a dramatic affect Activision’s stock prices and the upcoming downloadable content for Modern Warfare 2.

“We expect the very vocal gaming press to put the story front and center,” Schachter said in a note this morning, reports GameSpot.

He then went on to point out that “disruptions at Infinity Ward could, however, affect quality/timing of the downloadable content (DLC) for Modern Warfare 2 (which we estimate could contribute $0.03 -$0.04 in 2010 earnings per share). However, it is unclear at this point what the extent of the impact, if any, on the DLC will be.”

When first showing the Modern Warfare 2 teaser trailer (shown below), there was an underwater snippet shown, which left many questioning if there was going to be an underwater level of some kind playable in Call of Duty: Modern Warfare 2.

However, in a recent interview with GameTrailers TV, Infinity Ward cleared those questions right up. “It’s mostly… the opening to a level,” Infinity Ward’s CCO Vince Zampella told GameTrailers TV. “There’s not any underwater combat or anything… That’s how the CO’s generally infiltrate.”

That’s right. It seems that we don’t have to wait until E3 to get our hands on the a trailer that shows Modern Warfare 2 in action because on May 24th during the NBA Eastern Conference Finals on TNT we’ll be getting that chance. But, lucky they left us with a little tease, thanks Activision.

“Everyone on the team is laser focused on making the most gripping experience we’ve ever created,” said Infinity Ward’s CEO, Vince Zampella when the title was announced. “No detail is too small and every finishing touch imaginable is underway to make Modern Warfare 2 our best ever. We can’t wait for our fans around the world to play starting November 10th.”
