No Doubt is suing Activision for un-permitted use of their avatars within Band Hero, and they’re seeking damages for their avatars being turned into “virtual karaoke players”.

The band argues that it “agreed to place avatars containing their name and likeness performing three No Doubt songs”. However, the band never allowed use of their avatars beyond their three songs within the game; Band Hero allows their use in more than 60 other songs – along with that, individual band members can be “isolated into solo performances of these cover songs and placed randomly in countless variations”.

“Activision has deceived and confused the public into believing that No Doubt authorized the use of its name and likeness for the Character Manipulation Feature of Band Hero and that No Doubt approves and endorses the appearance of its members individually performing songs that are wholly inappropriate and out of character for No Doubt,” reads the complaint. We’ve contacted Activision to get its side of the story.
